![]() How to file Patent Application
A patent application can be filed directly with the KIPO (Korean Intellectual Property Office) or with the help of a legal representative (patent attorney).
After a patent application is filed, it would be published within 18 months from the filing date. Once the application has been published, it can¡¯t be filed again. It is recommended that an invention which is considered to be important should be filed with the help of a professional representative. Application forms for filing patent application can be obtained by downloading and installing Word Processing Software provided at http://www.patent.go.kr/jsp/ka/navigation/NaviStepC.jsp.
The essential parts of the Application Forms are Patent ¡°Claims¡±, ¡°Exemplary Embodiments of the Invention¡± and ¡°Figures¡±. The scope of the invention is defined by the ¡°Claims¡±, and embodiments of the invention are explained by the ¡°Exemplary Embodiments of the Invention¡± and ¡°Figures.¡± The scope of the invention should be described in the ¡°Claims¡±, and specific explanation of the ¡°Claims¡± should be described in the ¡°Exemplary Embodiments of the Invention¡± and ¡°Figures.¡± The ¡°Exemplary Embodiments of the Invention¡± and ¡°Figures¡± also help advance technology in the related fields by disclosing the invention. Patent application is published in one and a half years from the filing date. Published applications can be retrieved from a website www.kipris.or.kr.
